In 1926, Robert Herndon subdivided the land to the east and north of Rush
Lake and formed Herndon's Rush Lake Estates. This subdivision takes in the following
streets: Rushview, Rushside, Country Club, Mack, Herndon, Creston, Van Horn,
Elmhill, Deering, Sunnycrest, Higgins and Rush Lake Road.
In 1926, Robert Herndon also subdivided the land to the south of Rush Lake forming
the subdivision known as Vista On The Lake. During 1957 he formed an addition
to this subdivision called Robert Herndon's Addition to Vista On The Lake. These
two subdivisions take in Junior, Forestlawn, Bernice, Recreation, Orchard, Mayfred
and Pettysville.
In 1953, Robert Herndon subdivided land along the north shore of Rush Lake. This subdivision was called Herndon's Rush Lake Estates #1 and includes properties on Rush Lake Road from Herndon to just east of Scotia.
In 1954, the land surrounding the two canals on the northwest side of Rush Lake was subdivided and formed Watson's Rush Lake Subdivision. This subdivision is comprised of Nesbit, Scotia and Baudine.
Robert Herndon also formed a subdivision called Robert Herndon's Rush Lake Estates #2 which takes in the homes on the east side of Pettysville Road. These homes are not within our Association boundaries.
Prior to 1955, the owner of the property on the west end of Rush Lake, proceeded to dig some canals on his property. When he began to dig, the canals were not connected to Rush Lake. After a period of digging, he broke through to connect the canals to the lake. At this time, the water in the lake began to disappear. The property owners in the area at the time, took him to court and a legal lake level was established for Rush Lake. This legal level was set at 876.9 feet above sea level. A cement post with the markings affixed was placed along the shoreline of Rush Lake. The court also required that a dam be built to maintain the level of the lake. The dam was built at the west end and the owner of that property was responsible for its upkeep. The Moon Shadows Association now owns this property although the Rush Lake Association does monitor the condition of the dam as they have the legal right to step in if the dam is not maintained satisfactorily.
Following this experience, property owners decided to form an Association in an effort to protect the Rush Lake area. Legal papers were filed and the Rush Lake Property Owners Association was incorporated in 1956.
The Rush Lake Property Owners Association is formed under the Summer Resort Owners Act 137 of 1929. Unlike many associations being formed today under more recent acts, Act 137 makes membership in the association mandatory. If one does not pay their membership dues, this act allows the association the right to file a lien on member's properties for non-payment of assessments.
In 1965, the Association set the boundaries of the Association. These boundaries were for the subdivisions of Herndon's Rush Lake Estates, Herndon's Rush Lake Estates #1, Watson's Rush Lake Subdivision, Vista On The Lake and Robert Herndon's Addition to Vista On The Lake. There was also a small parcel of land that falls between Herndon's Rush Lake Estates #1 and Watson's Rush Lake Subdivision. The property at the west end of the lake was also included in our boundaries and was listed as Southwest Quarter of the Southwest Quarter of Section 17, the Southeast Quarter of the Southeast Quarter of Section 18, the Northeast Quarter of the Northeast Quarter of Section 19 and the Northwest Quarter of the Northwest Quarter of Section 10, of Hamburg Township. The Association held their first meeting on August 28, 1965.
In 1990, the property on the west end of Rush Lake was sold and subdivided
which formed the Moon Shadows subdivision. The streets of Moon Shadows are Bay
View, Bay View Court, Dana Pointe Drive, Shadowbrook Lane, Sea Breeze, Sand
Pebble Cove, Moonlight Bay and Anacapa Bay. This subdivision encompasses the
quarter sections mentioned in our original incorporation. The southernmost section
of Moon Shadows encompassing about 27 lots was not part of our original boundaries.
The Association membership voted to include them in our Association in 1994
and final approval was given by Hamburg Township in 1996.
