This is intended to clarify the Boating Regulation Ordinance shown in the March/April Newsletter.
Lot Size/Boating Regulation Ordinance
Amended February 8, 2000
Due to the fact that Lake Residential Lots were increased from 80 feet to 100 feet it was necessary to change the Boating Regulations to fit with the new Frontage size.
Ordinance 18/Article 1 in Porter Township states that "as the shore lines of lakes become further developed, the cumulative
impact of boat usage from each respective property must be regulated in order to preserve and protect the right of riparian
owners as well as the Township as a whole.".
In keeping with that, the township adopted new changes to the laws concerning the
number of watercraft a property owner can have.
Ordinance 18/Article IV
Sec. 4.1 Not more than two (2) watercraft shall be launched and/or docked adjacent to each separate frontage.
(Lots platted 1992 to 2000 required Frontage was 80 feet and restricted to 1 boat per 80 foot frontage. Lots platted before 1992 have varied footage requirements and restrictions)
Sec. 4.2 If the continuous length of a separate frontage is greater than 100 feet, two additional watercraft may be launched/docked for each 100 feet of continuous frontage in excess of the initial 100 feet.
Watercraft means any water vehicle having a motor or engine of more that fifteen (15) horsepower. Violations of this regulation shall be punished by imprisonment of not more than 90 days or by fine of not more than $500, or both.
To put it a little differently:
Lots platted prior to 1992 have varied frontage requirements and restrictions.
If the lot was platted during 1992 thru 1999 the requirement is 80 foot frontage and 1 boat only.
If platted after February 8, 2000 the requirement is 100 foot frontage with 2 boat per 100 foot.
